Terms of Service

By downloading, installing, or using the CruiseChattr mobile application (the "App") or visiting our website at cruisechattr.com (the "Website"), you agree to be bound by these Terms of Service ("Terms"). The App and Website are collectively referred to as the "Service."

If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and CruiseChattr ("we," "us," or "our").

You must be at least 13 years of age to create an account and use the Service independently. Users under 13 may use the Service only within a family group created and supervised by a parent or legal guardian.

By using the Service, you represent and warrant that you meet the applicable age requirements and have the legal capacity to enter into these Terms.

To access certain features of the Service, you must create an account. When creating your account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided during registration is found to be inaccurate, misleading, or incomplete.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Send messages that are threatening, harassing, abusive, defamatory, obscene, or otherwise objectionable
• Impersonate any person or entity, or falsely claim an affiliation with any person or entity
• Send spam, unsolicited advertisements, or promotional content to other users
• Attempt to access other users' accounts, messages, or personal information without authorization
• Interfere with, disrupt, or overload the Service or its underlying infrastructure
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
• Use the Service to distribute malware, viruses, or any other harmful software
• Use automated systems, bots, or scripts to interact with the Service
• Circumvent, disable, or interfere with any security features of the Service
• Use the Service for any illegal activity or to facilitate illegal activity
• Collect or harvest personal information of other users without their consent

CruiseChattr is designed for personal communication between cruise passengers. When using the messaging features, you agree to the following guidelines:

• Be respectful and considerate in all communications
• Do not share content that is illegal, sexually explicit, or depicts violence
• Do not share other people's personal information (phone numbers, cabin numbers, etc.) without their consent
• Do not use the messaging system for commercial solicitation or advertising
• Do not send messages that could cause panic or concern among passengers or crew
• Report any inappropriate behavior or messages through the in-app reporting feature

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these guidelines, including removing content, suspending accounts, or reporting to law enforcement.

By using the Service, you acknowledge and agree that:

• Your device participates in the mesh network. When the App is running, your device may relay encrypted messages from other users. You cannot read or access these relayed messages as they are end-to-end encrypted.
• Message delivery is not guaranteed. The Bluetooth mesh network depends on the density and proximity of CruiseChattr users. Message delivery times may vary, and some messages may not be delivered if there is insufficient network coverage.
• Bluetooth must remain enabled. The Service requires Bluetooth Low Energy (BLE) to function. If you disable Bluetooth, you will not be able to send, receive, or relay messages.
• Battery consumption. The App uses Bluetooth Low Energy, which is designed for minimal battery impact. However, individual battery impact may vary depending on your device model, settings, and usage patterns.

The Service, including its original content (excluding user content), features, and functionality, is owned by CruiseChattr and is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Our trademarks, service marks, trade names, and logos may not be used in connection with any product or service without our prior written consent.

Ship data displayed within the Service is sourced from publicly available information and third-party data providers. Such data remains the property of its respective owners.

You retain ownership of all content you create or share through the Service ("User Content"), including messages, profile information, and group names.

By using the Service, you grant us a limited, non-exclusive, royalty-free license to process your User Content solely for the purpose of providing and improving the Service. Due to end-to-end encryption, we cannot access message content — this license applies only to metadata and account information necessary for Service operation.

You represent and warrant that your User Content does not violate any third party's rights, including intellectual property rights and privacy rights.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• Messages will be delivered within any specific timeframe or at all
• The Service will function on all devices or in all environments
• Any errors or defects in the Service will be corrected
• The Service is free of viruses or other harmful components

CruiseChattr is not a replacement for emergency communication systems. In case of emergency, contact your ship's crew directly or use the ship's emergency communication systems. Do not rely on CruiseChattr for time-critical or emergency communications.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CRUISECHATTR, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to, use of, or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Failure or delay in message delivery
• Any loss or damage caused by reliance on information or content provided through the Service

In jurisdictions where limitation of liability for consequential or incidental damages is not permitted, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless CruiseChattr and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through the App settings or by contacting us at support@cruisechattr.com.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

These Terms shall be governed and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through the courts of competent jurisdiction in Vancouver, British Columbia, Canada.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the updated Terms within the App and on the Website.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, please stop using the Service.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

These Terms, together with the Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and CruiseChattr concerning the Service and supersede all prior agreements and understandings.
